Protecting Benefits
Provisions to allow funds for the payment of medical and long-term care, guardians and personal living must be made in such a way that the child does not risk losing government benefits. These may include Medicaid, SSI, food stamps, subsidized housing and other public benefits, which are based on a person’s assets and income.
The funds in the special needs trust are designated to be used for your disabled child’s benefit. But they won’t trigger the loss of public benefits. Instead, they just supplement the public benefits.
